What is Health Reform?

March 23rd, 2010 marked the signing of the national healthcare law, the Affordable Care Act! Sometimes refered to as "Obamacare", this landmark piece of legislation impacts consumers acrose the country by improving access to quality healthcare and giving consumers the security and protection of knowing they no longer can be caught in insurance company fine print or ever go bankrupt because of medical bills. Young adults can stay on their parents' policies, preexisting condition discrimination will soon be a thing of the past (and already is for children) and consumers & small businesses can increase their options in purchasing insurance that makes insurers compete for them, not the other way around! What is Erisa and what does it have to do with it have to do with health insurance law? Who made it federal law and why? Why are some governors using it as the excuse not to enact the CAP program of the ACA in their states when it pertains to policyholders with commercial health plans in regards to filing appeals at the state level and through being able to file an appeal using their STATE court system vs having to use the federal courts which is what Erisa has consistenly limited them to.
Want to know why you see Erisa for years on all your insurance plan booklets but maybe have often have overlooked it in all their miles of “jargon when describing your RIGHTS OF APPEAL?” Basically because under Erisa all these years, you as the insured have had next to NO rights under this law and anyone who has tried to exercise it has bascially gotten NOWHERE. It sure made Enron’s widow filthy rich though under the retiree portion of the law which was the original intent when it was written.
Employee Retiree Income Security Act passed by Gerald Ford was to ensure that the retirements of employees remained solvent by companies who had sucj retirement plans for their employees but was expanded upon to include the protections of an insured person’s right to appeal their greivances with their insurance company in the event they felt their claim was handled or denied wrongly but only gives that person the option after going through the insurer’s internal appeals process to take that process through the federal court system and with the ACA, there are provisions that will allow people to utlitize state courts to appeal-Governors like Scott Walker refuse to implement this stating, “this is waste of taxpayer money since we already have provisions in place for people to appeal and why duplicate a process for appeals?” He is advocating that Erisa is “good enough”. So much for “state’s rights” eh?
Erisa has also been expanded in the area of health insurance and healthcare when COBRA was enacted as an add-on as well as The Women’s Wellness Program. COBRA has also been proven to be ineffective as most QBs who fall under the “job loss qualifier” cannot afford to pay for their premiums in full when on unemployment to continue their group coverage and opt not to take COBRA anyway for the 18 months. COBRA continuation depending on the qualifying event can be extended for up to 36 months which at that time, if a person is still w/o insurance or reamins unemployed, they have the option to switch that same plan to an “individual terribly conversion policy” which next to nobody does. Provisions in the ACA, once fully implemented for all adults will make having to make these counter-productive, unrealistic coslty choices a thing of the past. Find out more about insurance appeals options and the CAP program of the ACA by looking at this in HealthCare.gov and learn about Erisa has been screwing the insurance comsumer all these years by googling Erisa or the NAIC laws.
NAIC-National Association insurance of Commissioners and see where YOUR Insurance Commissioner stands in your state on this issue. Mine is solely on Walker’s side. Good luck with your research and I suggest you DO IT!!!
